Can i still get refund once payment shipment is confirmed?

Hello paypal. I am having a business deal but he is saying without confirmation i cannot give you the software so if in case he scams me after confirming the product can i still get a refund or file a case against him?

If the payment status starts with "Payment", then you paid as goods and services, a dispute can be filed if you do not receive your goods.

The seller shouldn't be doing it this way, its foolish, they should ship or deliver what you ordered first since you have paid. It is PayPal that is holding the money, not you. Even if you do not confirm, they still will get the money eventually, if you don't report a problem within the 21 days that PayPal holds the money. Them withholding goods/services makes no difference. If the seller persists with this behavior, you might as well get your money back right now as item not received.
