scammed on e bay still awaiting refund

Hi
I bought an item on e bay and paid with paypal
within 30 mins e bay e mailed me and said the seller and the item has been removed
and my purchase has been cancelled
e bay have contacted paypal and said a refund will be issued to my account
I am still waiting for this refund
as I wish to buy the same item from a trusted seller on ebay
and have it in time for Christmas
you would imagine that paypal could speed things up knowing that ebay have explained the situ to them
very very frustrating and takes the good out of everything

Is the item/order wiped off of your purchase history?
Is there a refund transaction showing in your PayPal account for the payment? The length of time it takes depends on how the payment was funded.
If funded by bank payment, it takes 3-5 business days after refund is marked completed and goes in your PayPal balance.
If PayPal balance, it should be instant and in your PayPal balance.
If credit/debit card, it takes up to 30 days and refunded back to your card.

item is still showing in paypal
opened a case with ebay { which they looked at and agreed a refund } then closed the case
case with paypal is still open
says awaiting to hear from seller
this seller had no feedback and no previous sales record with e bay
e bay closed the sellers account and promised me a full refund
item was paid for by my paypal balance
still no refund as of yet

What a total disaster this is , both on ebays and paypals behalf
I am still awaiting a refund and time is running out for delivery of a new purchase before christmas
very very disappointed in it all
e bay promised a full refund within 24 hours that time limit has come and gone
its a simple situ . as explained before
the buyer does not exist , e bay closed their account and removed them from their site
e bay contacted paypal about this matter
yes I am still in the cold over this . where is my money ????
buyer protection ? hmmm I wonder , after several mails etc etc still nothing
not a great scenario at all

it is only giving me two options
CANCEL CASE or CHANGE CASE TYPE
there is not an option to escalate to a claim
totally frustrating

Click on the words "Help / Contact" at the bottom of paypals pages and use the phone option in the blue band at the top OR very bottom of page dependent on what country you are in. Scroll down past the list of help questions and click on 'Call us' bottom of that page. Log in and get the code.

Ok my case is closed as the seller does not exist
I have sent paypal a message and asked them to refund my money within 24 hours
this should have been done last week according to e bay
if my refund does not come into my account
I will take LEGAL ADVICE
totally fed up with the situ and the response for both parties
its pass the buck time . so much for buyer protection ?
where is my money ? who has it ? but where is my refund ?
I will try add a copy of the chat with ebay
I am running out of time to buy items for Christmas { thanks paypal }
this is a simple situ that should have been resolved quickly
