Seller protection on a racing engine built in USA for German Customer

I have a German Customer requesting I have a Ford V8 racing engine built for his race car by my engine builder here in the USA. The engine will be built, ran and tested including a video of it on an engine dyno running at racing conditions. We produce a quality product but there is no warranty on a racing engine. Since the buyer is in Germany, there is no way to check and approve the correct installation of the engine. Are racing engines exempt from buyer protection? Am I covered as the seller if they claim the engine is faulty? Thank you for your time.

Custom made items are not covered under buyer protection except when the buyer files Item Not Received (INR) claim. However, if buyer paid with credit card, they can exercise their chargeback rights which is different than a PayPal dispute are more broader in dispute terms should they fail to win a PayPal dispute or forego a PayPal dispute altogether to chargeback directly with their financial institution.

https://www.paypal.com/de/webapps/mpp/ua/buyerprotection-full?locale.x=en_DE

So follow the basic and additional requirements for protection with Item Not Received claims:

https://www.paypal.com/us/webapps/mpp/ua/useragreement-full?locale.x=en_US#seller-protection

Still, if the buyer filed INR, they may have a hard time filing a Not as Described because how can something be not as described if they did not receive it, n'est-ce pas? And PayPal will have a good case to fight. But this is all speculation, and depends on the actual circumstances of the case as this transaction has not commenced yet.

Kudos & Solved are greatly appreciated. 🙂
