Opening a case against buyer after refund issued

So I accepted a phone return from an ebay buyer. It was past the 30 day time limit but they were super old and couldn't figure out how.to use the phone I sold them so I felt bad and accepted the return. After I received the phone I checked if it was scratched up and since it wasnt I refunded the buyer. I found out just recently that their email is stuck on the account and I cant resell the phone until I delete it. I need their password to do it but they aren't responding to my messages anymore. Can I open a case against them? I cant resell the phone in the condition it's in. Please let me know what you think!

Seller can't open disputes against buyers.
