buyer won't respond to claim?

i opened up a case with a buyer who i believe was a fraud. i paid for the item, then he became an unregistered user on ebay. i tried emailing him several times and he didn't respond. so i opened up the case. he had until feb 15th to respond. he hasn't. do i get my money back even if he didn't respond??
