Paypal won't help with a refund when what I bought is completely different to what I received

Hi I purchased a watch for nearly #3000 and paid through paypal as I thought it was the safest option. I received the watch which was completely different colour. The one I bought was bvlue and the one I received was black. I asked them to send it to DuvBai as I was there but they sent it to the UK. When I went home at Christmas and saw the watch I contacted Paypal immediately and the stotre. The store refused to give me a refund so i dealt with Paypal. 

 

I left the watch in the UK so my sister could post back to New York. Paypal said I must take it to a jewleers for them to **bleep** it. I advised them that i left in th euK and would have to get it sent her which I did. It still has the unbroken seal on supplied by the seller. I took it to the jewellers in Dubai who assesed it and made a clear statement saying that this was  not the watch on the advert that I bought. The watch I bought was very clearly blue and the one they sent was clearly jet balck. 

 

Paypal refuse to get my refund. I am extremely disapponted and need to know how to get my money back. Its not a few pennoes but a lot of money!!

Firstly for a sellers seller protection they have to send the item to the paypal registered address of the buyer, they can't send to a different international address.

 

Secondly paypal buyer protection covers items that are ''significantly'' not as described as per below >>

 

 

13.8 What is Significantly Not as Described (SNAD)?

  1. Your purchase is Significantly Not as Described if it is materially different from the last description of it that you received from the Payment Recipient before you paid for it (which, for exclusively online purchases, shall be taken to be the Payment Recipient’s description of the purchase in the relevant online listing) (“Purchase Description”). Here are some non-exhaustive examples:
    1. You received a completely different item. For instance, you purchased a book and received a DVD or an empty box or the software that you received was not the software that was sold to you.
    2. The condition of your purchase was misrepresented. For instance, the listing for an item said “new” and the item was used.
    3. Your purchase was advertised as authentic but is not authentic.
    4. Your purchase is missing major parts or features and the fact that these parts or features are missing was not disclosed in the listing.
    5. You purchased 3 items from a Payment Recipient but received only 2.
    6. Your purchase was damaged during postage.
  2. Your purchase is not Significantly Not as Described (SNAD) if it is not materially different from the Purchase Description. Here are some non-exhaustive examples:
    1. The defect in your purchase was correctly described by the Payment Recipient.
    2. Your purchase was correctly described but you didn't want it after you received it.
    3. Your purchase was correctly described but did not meet your expectations.
    4. The item that you purchased has minor scratches and was listed as used condition.
    5. An event you purchased tickets to was postponed.

 

 

I guess the fact that the watch was perfectly described but just the wrong ''colour'' would not count as significant.

However if you bought the watch from a seller in the same country you would have the option of the small claims court or similar, but you lowered your protection by buying internationally.

 

My only suggestion is did you fund that paypal payment via a credit card? If you did then why not contact your card issuer and see if they will help you with a chargeback if you offer to return the item??
