Help! Lost case and appeal for faulty iPad? Help

Hi there, So I purchased a iPad 3 mini on 20th November I received the iPad, opened it all looked fine, charged the iPad to 100% but Within a few minutes it had dropped to 97% which I thought was abit weird but didn’t think much of it anyway I wrapped this up for a gift for my little girl for Xmas, gave it her for Xmas and as she was playing on it which was for about 40mins battery had gone from 100% to 2% now we have had another iPad in the past and it’s not lost the battery that quick, I’ve looked into this online, I’ve even complete reset it and made sure nothing was running in the background making the battery run down, now when we charge it it gets dangerously hot like you can’t even touch the back casing which is very worrying, what we have also noticed is that the home button jams and doesn’t work all the time and when pressing the keys on the touch screen it just won’t let us type so we have to use voice command, but my decision in the last week was to keep this turned off because of the charging issue as it is very dangerous and I’m worried it will set on fire, so by what I’m exposing to you this is not normal behaviour and it’s definetly faulty and a fire risk, now when I purchased this iPad the listing was described as ‘Great condition Full working order’but That is definetly not the case! So I contacted the buyer no response, opened a case it got declined because it had gone over the buyer return window which is understandable, so contacted PayPal they opened a case but Within a few days PayPal favoured the buyer because it violates PayPal acceptable use policy, so I rang them and explained the situation and the guy said that he would appeal the case because it’s not acceptable to receive something that’s so faulty after paying nearly £200 that was described correctly and that is a risk, but this morning yet again the case got favoured with the seller because of the terms of use policy, now I don’t think this is fair atall and now I am left with a iPad that I can’t use, does anyone else agree and can anyone give any suggestions as to what I can do! Also the iPad is not in warranty with Apple anymore Thanks
