Seller wants me to close case before discussing a refund for items not recieved

I purchased some cds as a birthday gift on next day delivery a week passed and so did the birthday so after communication stopped I opened a case with PayPal now the seller has asked me to close the case before discussing the refund should I do this as it sounds a bit wrong or should I maybe escalate the issue to a claim

If you close the dispute the seller can ignore you and you would not be able to open another one.
I would tell her to issue the refund now and that would automatically close the dispute anyway and if she refuses then escalate to a claim.
Advice is voluntary.

That Is what I was thinking but they have said they don't have the money as it is on hold as I opened the case does this sound right just checking before I contact them

The funds would be on hold but to have them released to you the seller just needs to contact our customer service.
