Paypal breaking their own user agreement?

i bought software that turned out to be pirated. paypal are refusing to refund me the money saying i'm not covered. point 13.9 of their very own agreement says i can be refunded if an item is advertised as authentic and turns out not to be. I've getting no help whatsoever by some character called Esther who seemingly cuts and pastes stock answers and doesn't address any points i make, or even seems to acknowledge the above fact.
anyone else had experience like this?
i've been a loyal paypal customer for many years, and i'm disgusted at the way they're treating me.

Hmm. The buyer protection doesn't currently cover downloads, was this software downloadable or something that was posted to you and then turned out to be counterfeit?
