Seller refused to sell me item

Hi I won an item and shortly after I got an email from the seller saying he would not sell me the item

He opened an dispute saying he sold it to another.

I responded I was not ok with this at all but the dispute was closed anyways.

Is there anything I can do about this  I did not close it... 

I am very unhappy with this seller he sold outside of ebay !
