best way to go about returning item to seller if item is damaged and getting money back when seller is not wanting to comply

Go to the transaction in your PayPal account and click "Report A Problem". It should let you file a "Significantly Not as Described" dispute. You will have to pay for return shipping but you can register for PayPal Return Shipping on your account to get reimbursed.  Google "PayPal Return Shipping".
