Have you been UNFAIRLY treated by PayPal when it comes to dispute with the Buyer?
I am a virtual service seller. I sell Virtual Assistant services to clients online and just recently a buyer filed a dispute on me and PayPal have resolved the case in just 28 minutes. Yes! you read it right, the case was resolved and I already received an email resolution stating that they have thoroughly check on evidence and it was in favor of the buyer in LESS THAN 28 MINUTES. See photo attached:
For the record, they did NOT give me a chance to hear what I have. in case you want to know what I have as evidence, I have sent a PayPal invoice to the buyer that has a TERMS and CONDITIONS stating that upon payment, the buyer agrees that payment is NON-REFUNDABLE. And YES, the word, NON-REFUNDABLE, is in ALL CAPS and buyer was informed beforehand. See attached pic of invoice:
However, PayPal still insists that they have decided it accordingly and fairly.
Is it fair? Please let me know your thoughts.
Unfortunately you have 0 seller protection for virtual items, you can sell them but at your own risk.
Stating things are non-refundable is pointless as Paypals terms and conditions which you agreed to when you opened your paypal account outweigh your policy if it contradicts theres.
Can you cite or provide a link of the Terms and Conditions that PayPal has that outweighs what I have written in the Terms and Conditions in PayPal Invoice?
Also, how would you assess the 28 minutes time span for PayPal to say that they have carefully checked and fairly decided on the matter?
Do you think this is fair?
Thanks for your thoughts.
Go and read you own seller protection criteria, it states firstly that seller protection does not cover virtual items.
It also states that buyers are covered by buyer protection for 'non receipt of item or service' OR 'item received but not as described'.
So if a buyer is covered by paypal for non receipt of item etc that out-trumps your 'not responsible' clause.
I will check out and see what you are talking about "seller" and "buyer" protection in terms of virtual items. But as far as I know, PayPal has updated their Terms and Conditions. Hence, PayPal Purchase Protection is now being extended to intangible or virtual items and services.
It bugs me thinking of the following:
1.) If indeed the Terms and Conditions in PayPal Invoice Template is deemed USELESS even if the BUYER was informed of the clause NON-REFUNDABLE, what's the use if such in the template?
In fact, the MAIN reason why it was indicated in ALL CAPS is for PayPal to know (like Affidavit) that both parties agrees, specially the buyer, about the "Non-refundable" payment for the protection of SELLER on online scammers.
2.) Is it FAIR to decide and for PayPal to email me that they have FAIRLY and CAREFULLY looked into the issue in favor of the buyer in JUST 28 MINUTES and WITHOUT EVEN looking into my side of story?
These bugged me so much!
Hence, PayPal Purchase Protection is now being extended to intangible or virtual items and services.
Yes purchase protection is as that is buyer protection but you are not the buyer, you are the seller.
Wish I could help, but I can't.
PayPal takes advantage of sellers of physical items too.
I sold on eBay items to be repaired, with complete descriptions, on a deeply discounted on a non-returnable basis.
After a month, without any statement that any of my descriptions were inaccurate, PayPal authorized return.
They buyer claimed he returned the items (I have not received them). PayPal gave him back his money.
It seems to be impossible to get a human to respond on PayPal. Messages will claim that they are forwarding my messages in the message to a resolution specialist, but I have yet to see any human response.
We need some consumer protection.
I feel you, I was stolen 1000 euros after GIVING THE SERVICE JUST 5 MONTHS AGO.
This is really unfair. My bad I did not make any copy of the contract as my lastpc was broken.
bigprice.it says I didn't give them the service but... stage.bigprice.it is the service I gave to them in june. And they just thought to ask a refund IN NOVEMBER? I feel Stolen from my work, time, money and first of all respect and feelings.
