Seeking help

Hi, I've recently purchased a 1200$ statue (shipped from Italy to Slovakia) and want to ask you about some weird things with the seller. The statue arrived damaged, so I filed a damage claim with UPS, sent photos and other documentation, and they accepted the claim and told me that they will proceed to refund the money to the seller. Later on, however, the seller contacted me that they want additional 160$ for shipping costs before proceeding with the refund. As it turned out, he wrongly entered the shipping details - lowering the size and weight of the package and therefore the total shipping cost. (Paid 50$ for it instead of 210$). I wouldn't mind paying the additional 160$ but as it turned out, the seller doesn't have any documentations regarding the value of the item (bills for the statue) and the shop where he bought the statue did apparently close a long time ago. I asked my local UPS team if providing them with the prices on websites on which the statues were being sold would be enough but they answered that they will consult this stuff with the seller. 1,5 month has passed since then and my patience is running out, it's a simple yes or no question and the seller wasn't able to get me the answer yet. Furthermore, as I realized, some parts of the statue must have been broken prior to the shipment because he said that it should be like it (with two displayable broken parts (the statue arrives in multiple parts that are suppose to connect with magnets)) when I contacted him about the damage. Should (and could I still? -> it's been 2 months since the payment) I open a damaged item claim? I'm afraid that I will be forced to ship the statue back to the seller, the shipping costs are outrageous here in Slovakia, it would cost 400$ to ship the statue back and I didn't know that before the purchase bacause the seller purposefully entered wrong details. Could you please help me out with this situation? Best Regards, Marko

Why are you doing all the work, its up to the seller to put in claims for damaged goods, what you should do is...........

How do I open a dispute with a seller when a purchase goes wrong?

You can open a dispute in the Resolution Centre of your PayPal account within 180 days of payment if:
•You don’t receive the item OR service
You receive an item but it’s significantly different than the description on eBay or on the seller’s website (or you receive a totally different product ie broken).

By opening a dispute, you can communicate directly with your seller to work out a problem transaction.

If you reach an agreement with the seller you can close the dispute. If you're still not happy with the result, you can escalate the dispute into a claim. Paypal will review the claim and decide on reimbursement.

These steps apply to Personal accounts. If you have a Business account, please log in to see the steps that apply to you.

To open a dispute:
1.Log in to your PayPal account.
2. Click on the transaction and use the resolve a problem option at the bottom of that details page.

Note:
•Generally buyers must wait at least 7 days from the date of payment to escalate a dispute for an item not received
•Where an item has not been received, please ensure you have given the seller enough time before opening a dispute

Do not close the dispute until you have a refund or your item.
If a seller states that they can't refund until you have closed the dispute don't believe them.
Escalate the dispute to a claim within 20 days (before it times out), if you need Paypal to get involved.

Activate the below link in case you have to return the item at Paypals request (or the correct one for your country as this is the U.S link).

https://www.paypal.com/us/webapps/mpp/returns

If that does not work then if you funded your paypal payment via a card then contact your card issuer and see if they will issue a chargeback.

Advice is voluntary.
Kudos / Solution appreciated.

Hi, the seller also purposefully entered wrong measurements and weight in order to lower the shipping cost. It would cost 400$ to ship the statue back and I didn't know that prior the purchase (because as I said he entered wrong measurements). It would be cheaper to just get the statue repaired. Is there any way I wouldn't have to pay for the shipping? Paypal covers only <30 $ shipments.
