Query regarding dispute claims and time

I have opened a dispute on a seller as the items I received are damaged. The seller has agreed to send a replacement item. My query is as follows:

 

The item will be shipped from China and will most probably take about one month before it arrives but the dispute will close before this date. In this case what am I suppose to do?

If the seller didn't send the item (but he claims that he did) and the dispute closes automatically I will not be able to re-create it which leaves me with a damaged item and no refund.

If I escalate the dispute to papal, they will most probably close it also themselves in the favour of the seller as they can see I am waiting for the items.
