Paypal helps a Scam Merchant scam me

Hello , Paypal have just now , closed my dispute with a merchant very unfairly !! . From the moment I payed this merchant , I never got a receipt , Never got tracking , no acknowledgement whatsoever that I had bought anything . I twice wrote to the merchant, and was ignored, So I took out a dispute through PayPal . Now you tell me that my dispute have been closed as apparently proof of delivery has been given by the merchant . This Can Not Be True !! Nothing has been delivered !! I demand to see proof of delivery . This is horribly unfair !! I was buying shoes from a company claiming to be a American company , and in fact it turned out are Chinese , Which would be fine if they were legitimate . But the merchant with the help of Paypal have Stolen my money and not given me as much a receipt ! I am not going to accept or allow Paypal to do that . I have been using paypal since 2007 without ever a problem and this is how I am treated ??   I have asked paypal to provide me with the 'proof of delivery' they were given and have heard nothing back .

Hi Neil McCarthy. I too have had a similar experience like youve had. I'm so frustrated and feel utterly let down by Paypal. I have been dealing with Paypal for a good many years and in my hour of need they have thrown me under the bus. They have closed my case and hung me out to dry. Another Chinese **bleep** company called Kainuode E-Commerce Co. Limited in Kowloon, Hong Kong.

Forgot to mention my name, Dermot <removed>. The item that I ordered was an electric car jack kit. I got an electric fob off toothbrush in the post. Didnt know who it was from, only that it may have come from this scamming company in HK. I hope you get this email as I like yourself have sent so many emails to that company and Paypal without getting any acknowledgment from either of them. Only the ones from Paypal saying that my claim was denied, etc. I want to name and shame that company, Paypal that is ! For allowing a company like Kainuode E-Commerce Co. Ltd. , to operate and let vulnerable people like yourself and myself get caught by these scammers. They have a responsibility to customers who use their service to protect them from abuse. They are patently not doing that.

Yep, I'm currently in a dispute with a Chinese scammer and PayPal is being very recalcitrant. It's pretty clear cut, they advertise one thing, send another, then refuse to refund. 

PayPal needs to take care of us LONG TERM users rather than protect these fake Chinese scammers.

Chinese Web Sites or on Social Media ads easy to spot (once you know the below signs) so buyer beware.

Paypal would not be able to check every individual seller / merchant / company in over 200 countries worldwide that adds paypal to their website to accept payments.

So they give you 'some' buyer protection but the onus is on you to risk assess your transactions.

They do stop bad companies from using Paypal when enough claims start rolling in.
However as they are in China (mostly) then its easy for them to just start over with a new name, so stopping them does not really do anything.

The best thing is to not buy from them in the first place, to recognise them -

1. No return address on the returns policy. The site will look as if its in your country (where they despatch goods from) but they will ask for returns to go back to China (returns depot) at a shipping cost often more than the item is worth.
2. No contact telephone number. if you click on contact the most you will get is webmail or an email address.
3. Rarely company address information.
4. Great pictures of items at bargain prices that turn out to be tat.
5. Fake reviews.
6. Google and you can often see previous company names as they change them once enough claims roll in and Paypal stop them using their services and start over.
7. Send fake tracking numbers to win item non receipt of item claims.

Paypals non receipt disputes are mostly automated so tracking shows delivered = seller wins.

So then you have to do some work to enable paypal to get you back some money from your chosen seller so...........


APPEAL

To submit an appeal on the dispute that was closed, PayPal asks that you obtain a detailed report from the shipper/courier (on their letterhead or some other form of official stationary) that includes the address the seller gave them for the shipment. Or one that includes a statement mentioning your address and saying the item was delivered to a different address.

When you have that, contact PayPal via phone (log on to your account and click Contact at the bottom of the page, however that may not be an option at the moment due to covid), or via Facebook (send a Private Message to PayPal) or via Twitter (send a Direct Message to @AskPayPal) and say you want to appeal the denial of the dispute based on the shipper saying the item was delivered to a different address. Once it's submitted (you will be provided with directions on how to do that), the dispute will be reviewed further and a determination will be made.

You also have the option to contact your card issuer if you funded your paypal payment that way and see if they will do a chargeback for you.

Very Helpful ! Thank you so much for taking the time. Though I have lost a lot of faith in Paypal, I will follow your advice and report back . I feel Paypal owe you a depth of gratitude for offering concise and engaged advise to  the likes of me .
