Paid twice for same order. Seller refusing to issue refund of e-cheque.

I paid twice for the same order. I mistakenly paid with an e-cheque and then asked the seller to make a new invoice and I paid immediately with a debit card. I was promised a refund when the e-cheque cleared. This has not happened and I have been fobbed off and now my messages are being ignored. PayPal have been less than useless and they can't the tell the difference between the order and that was paid by e cheque and the debit card payment.
I thought PayPal protected customers!
