Not sure how to update to a dispute

Filed a dispute against a company who did not provide an item as it was 'out of stock'.  Had confirmation email from them stating it was due to be refunded.  This has never happened so opened a case.  How do I escalate it to a claim and how long do I have to wait until I can do this?  No option is appearing at the bottom of the page as suggested in the help from paypal.
