So I am in the process of being scammed. I know 100% sure that the person I am dealing with is a scammer. He sent a package which will probably be empty, and I will have to pay customs for it in order to retrieve it and prove that I have been scammed. Will I be able to force the seller to cover the customs cost after the dispute?

Only if you take private legal action against him which you won't be able to if he is in another country.
