I can’t escalate my dispute into a claim

Hello, basically I wanted to escalate my dispute into a claim because the seller contacted me saying that he doesn’t want to send me the item, however he does not know how to do a refund on paypal, so I decided to create a dispute under item not received, however when looking for the escalate to a claim I could not find the button because the seller wouldn’t respond to the dispute, i was prompted with app.messages.buyer.CannotEscalateYet, how long should I wait, or is there any other way I can escalate into a claim?
