Help with case - closed in seller's favour

In essence I am VAT registered and can therefore obtain a credit or refund from HMRC in respect of payments to VAT registered sellers for any item subject to VAT. Therefore I expect as part of the 'delivery' there will be a VAT invoice or receipt. Where a seller registered for UK VAT refuses to provide one, I simply ask for a refund of the VAT element representing my loss. In this case I was a little beyond the eBay 90 day time limit, so I created a case with PayPal for the refund of the VAT element. In the past I have been successful, but on this occasion I got a message saying the case is closed and "Decided in seller's favour" without any explanation. Any suggestions on a way forward? I guess the banking ombudsman is next before County Court action to reclaim my loss as per PayPal guarantee? It seems impossible to open an appeal.
