Fraudulent Seller and no help to get the refund for months

Hello,

Ok so on 3rd October 2020 through eBay I completed a transaction for a pre-order item.  Since then I have been in constant communication with the seller and have been delayed constantly since I raised my concerns about his sincerity in supplying the item I paid for. as 2weeks after the expected delivery date I still had not received the item I paid for.
Now yes I'm a little 
naïve when it comes to online shopping but after researching the seller and reading that I was covered by eBay & with PayPal I believed I was covered incase of further delays. I was then told by the seller that it was ok for the the delay as it was  pre-order item and not released yet.
However as more time has gone on the seller has refused to answer my questions for authenticity of the sale and then my requests for a refund when it became clear that he was not intending to supply the item I paid for.
He delayed me for months, I have constant emails to him & responses from him saying he'll give me the refund later or I could just buy something else even though he never sent the item I originally paid or and still refuses the refund. I have multiple emails and statements from him that say he would give me a refund but then the next message where he asks if its ok if i jut wait further.
eBay couldn't do anything by the time I was able to get ahold of anybody and just told me to contact my bank and raise a dispute (which I have now done) it took me a month to even get a live person in a live chat box to talk to about this because the only contact numbers I could get a hold of were in the U.S. and being in Australia no one would answer and no one here had a contact number, and the same now has been happening with paypal for 2 months, whenever I go on a live chat im then told to contact them during business hour but i cant even find when they're meant to be.


The seller confirmed in emails 
that I was covered for up to 6months for a refund with the seller through PayPal. Unfortunately the seller is now continually avoiding my requests for a refund, has not mentioned the item I paid for in the past 2 months and is asking me to either now wait for April or to purchase something else for a discount even though I have not been refunded for or supplied the item I originally purchased. In April I would no longer be covered by the sellers protection for a refund.

It has also been found that other buyers on eBay have also raised concerns about this seller in the past 2 months, while I've been trying to resolve my own dispute, about this seller refusing to supply items purchased or give refunds in response to items not supplied.

 

Any advice or help on how to get through this and get my money back would help because I dont know what to do anymore, it was hundreds of dollars i'm out otherwise and I've even straight out asked the seller if he was a thief intending to steal from me, his response was to ask if i could wait until April.

How do I open a dispute with a seller when a purchase goes wrong?

You can open a dispute in the Resolution Centre of your PayPal account within 180 days of payment if:
•You don’t receive the item OR service
•You receive an item but it’s significantly different than the description on eBay or on the seller’s website (or you receive a totally different product).

By opening a dispute, you can communicate directly with your seller to work out a problem transaction.

If you reach an agreement with the seller you can close the dispute. If you're still not happy with the result, you can escalate the dispute into a claim. Paypal will review the claim and decide on reimbursement.

These steps apply to Personal accounts. If you have a Business account, please log in to see the steps that apply to you.

To open a dispute:
1.Log in to your PayPal account.
2. Click on the transaction and use the resolve a problem option at the bottom of that details page.

Note:
•Generally buyers must wait at least 7 days from the date of payment to escalate a dispute for an item not received
•Where an item has not been received, please ensure you have given the seller enough time before opening a dispute

Do not close the dispute until you have a refund or your item.
If a seller states that they can't refund until you have closed the dispute don't believe them.
Escalate the dispute to a claim within 20 days (before it times out), if you need Paypal to get involved.

If you lose because the seller provides a fake tracking number then post back here for more advice.
If the item arrives and its not what you ordered / not as described then make sure you change the dispute quickly from non receipt. If the dispute times out before you can change it then contact customer services to open a second dispute for the new reason.

If that does not work then if you funded your paypal payment via a card then contact your card issuer and see if they will issue a chargeback.
