Ebay and refunding returns

Hi

As a seller on ebay, i accept returns made within 14 days of purchase

This sale was made on the 24th january, and a return started on the 30th Jan, reason too small

After a few days on 6th Feb, as this was the date i should have made the refund, i entered the tracking details and the message indicated that the item had not been sent. I contacted the buyer requesting details, she ignored me, i tried communicating to resolve this 3 times, all went ignored. I have now recieved an ebay message telling me the item has been posted today! It is past the time in which i agree to accept and refund returns. The payment is obviously on hold, can i challenge this refund in this situation? I tried in paypal resolution center, but it says since this buyer has paid, i can`t open a case?

Your refund policy only applies to buyer remorse.

If the dispute is for non receipt or not as described then ebay and paypals policies over-rule yours.
