I have opened a dispute and have heard from my seller with a very vague answer of "it's coming, it's just delayed." I do not trust the seller, as I tried to contact them via their email 4 times prior to opening the dispute, and I heard nothing until I opened the dispute. At what point is it acceptable to either ask for a refund or escalate to a claim?

Whenever you want BUT make sure you escalate before it times out 20 days post opening of the dispute.
Advice is voluntary.
