Dispute disagreement

I started a dispute for a charge for a product that was a complete scam.  The response from the seller was that I return the item to them and they would issue a full refund, who is in China some where and took two months to get to me to begin with.  I am NOT sending it back.  But I do not see how to respond or to move it to a claim.  The option is just not there.  I basically feel like my hands are tied and that paypal is allowing me to get **bleep** by this company.
