Dispute closed and I `cant escalate to claim.

The product I have paid for and described as a "latest model of Smart Watch" received and it is completely different from the Smart Watch described in seller`s advertisement. Notably:

  • It has completely different design,
  • It has no built in GPS,
  • it has completely different menu,
  • it has different and terrible skins for clock and other application,
  • it has no LTE connectivity at all
  • it has different control methods as per absence of rotating bezel, as it was described
  • it is required to install additional SIM card, rather than described

 

and finally, it could be considered as simple mobile phone with very limited functionality rather than natural Smart Watch.

P.S. Moreover, it has some marks, as damaged packing, means it was previously opened.

All we need to advise you is...

 

have you opened a dispute?

which dispute did you open?

did you escalate to a claim?

was there a reason it was closed?

Hi,

have you opened a dispute? Yes I did, it was closed recently 

which dispute did you open? dispute about topic I`ve described - product is not as decribed

did you escalate to a claim? no I`m try to do this but unlucky there are no options as for now

was there a reason it was closed? "We have reviewed this transaction(s) and are denying your claim(s). This decision was made because if an item is materially similar to the seller's description, we do not consider it to be significantly not as described." Materially similar! it is a joke?

ok then your only option appears to be if you funded your paypal payment via a credit card then contact your card issuer for a chargeback?

I`ve a card for payments not a credit one and honestly have no clue how to do a chargeback.

I was really dissapointed by PP comment about "materially similar" it is completely out of logic discussing quite complicated electronic device. It is not a teaspoon which could be made from "materially similar" but a bit different type of steel which is not affect any functionality.....
