Dispute about a product that does not match the description

Hi everybody. I have a question for experts)
I live in Azerbaijan and often shop on the ebay site. Using the Reshipping service. Therefore, returning item in my case is always meaningless. Due to the expensive price of sending the goods back. Based on this, I always ask the seller before buying if the product is exactly new and sealed. And only after a reply from the seller I make a purchase. Unfortunately, not all sellers write the truth. And now I have a new case. I bought headset, which turned out to be not new. And the package lacks a cable and heading adjustment belt. Returning the item will be more expensive than the cost of these headphones.
Can I request a full refund without sending the product back, since this product does not completely match what I bought? I have a correspondence with the seller where he claimed that the product was new and sealed. Sorry for my english) Thanks
