Case Denied, never recd item

I hope someone can help me.  I ordered a 24 inch model of the Titanic, which plugs in and lights up from the inside as a Christmas gift for my husband.  I was told by the seller on December 9 the item was on the way from China.  I tracked it constantly, as I was worried it would not make it by Christmas.  Finally yesterday I got an email saying it would be delivered on December 23.  I was so relieved !  What I recd was a small envelope with a handmade fabric bracelet inside, and a card saying I was lucky etc in  broken English.  The tracking number they gave me on December 9 is right there on this envelope.  So it's a bait & switch, order Item 1 but get item 2.

 

I filed a dispute last night with Paypal.  Today I get an email saying my claim is denied because the seller provided proof of delivery.  They did NOT send what I ordered!  Just a bracelet that fits in the palm of your hand.  

 

Can someone please help me?

Surely you didn't open a dispute for non receipt of item? If you did then of course the seller would win if they provided trackable proof of delivery.

You should have opened a dispute for item received but not as described.


You are only allowed 1 dispute per transaction so the only way you can get a second dispute opened is to contact Paypal (when and if you can) and see if they will open a second dispute for you.
They may decline citing policies but if you say you made a mistake then they might open a second dispute for you.

If not then if you funded your paypal payment via a credit card then consider contacting your card issuer and see if they will help you with a chargeback?
