Can I return a counterfeit item back to the seller?

I was told the item I ordered on depop was authentic, however upon receiving it, it was obvious to be a counterfeit. I opened a dispute with the seller because she won’t give me a refund. The seller keeps stating that I need to return it in order to reciceve a refund. However, I did some research and I’ve see that many people State it’s illegal to return a counterfeit item and I may have to destroy it. Is this true? How do I get a refund from the seller if it is?
