Site has PayPal surcharge. Is it allowed?

A Merchant or Seller cannot pass on the transaction processing fees to their customers - this is called a Surcharge and is "clearly" addressed in the User Agreement. However, the Merchant or Seller can apply a "handling" fee to cover additional costs such as shipping/packaging materials and/or labor. The Merchant or Seller should have there policies explained on there web site for any additional costs incurred by the customer.

Yes, this is allowed. We do not encourage our Merchants to charge extra for using our services. We recommend that they should include any processing fees involved regardless if it is PayPal or a specific card used in online sales in the actual price listed.

Why does it state this in paypals user agreement then??.....confused.
No surcharges
You agree that you will not impose a surcharge or any other fee for accepting PayPal as a payment method. You may charge a handling fee in connection with the sale of goods or services as long as the handling fee does not operate as a surcharge and is not higher than the handling fee you charge for non-PayPal transactions.
Advice is voluntary.
