Right to refuse late delivery

I ordered some pet supplies from a store which stated 3-5 day delivery time. They went well over this and did not respond to my emails so I bought the good elsewhere. I received an email today to say the goods have now been dispatched. However, I no longer need them as I bought them elsewhere and already opened a dispute and escalated to a claim. Can I refuse to accept the goods with no financial loss or with a full refund?
