Past 30 day guarantee on eBay stolen item

I purchased an iPhone from a top rated eBay seller in February. This week the phone was deactivated by AT&T because it was claimed as lost or stolen on the original owners insurance. AT&T said they cannot do anything. Ebay said they cannot issue a refund since it was over 30 days ago, but said PayPal will issue a refund even though it was not purchased with PayPal. Has anyone had this happen? PayPals hold time is over an hour.
