Buyer hacked an Iphone I sold on Ebay now Pay Pal expects me to give him a refund

I sold an Iphone 6 on Ebay.  It was listed as network locked, Verizon Phone.  As soon as the buyer got it he paid someone to unlock it and I suppose he tried to use it on a different network and wasn't happy with the signal.  This phone was brand new, but it was locked to Verizon.  He first filed a complaint with Ebay but they found in my favor stating that he had buyers remorse.  When I refused to refund his money thru Ebay he threatened me and said he was going to report the phone stolen and report to the police that I stole the phone.  I ignored his messages.  Now he has filed a dispute with Pay Pal claiming that he cant get it activated with Verizon because it is stolen which is a load of crap.  I spent a week at the hospital while my father had open heart surgery and didn't check my email for a few days so I didn't get a chance to respond to this claim until the last minute but it seems like it didn't matter anyway.  I submitted my messages from Ebay showing he paid to get the phone unlocked and the Email from Ebay showing that they had closed the case in my favor.  I also sent them a copy of Verizon agreeing to activate the phone for me as an anonomous customer.  They can easily look at the listing on Ebay and see that it was a Verizon phone and it was network locked, but they are expecting me to accept the phone back and refund this jerks money.  I am not going to do it.  I don't know what he has done to the operating system of the phone and I'm no specialist when it comes to programming cell phones, so I have no way of ever knowing what changes he has made to it.  I am thinking of getting an attorney because I am not willing to accept the phone back since it is no longer in its original state.  Anybody have any suggestions as to how I should proceed?

I don't think there is much to do other than accept the decision by PayPal.

 

You could appeal, but you need absolute proof of your side of the case.  PayPal evaluates buyer and seller positions and decide whether buyer or seller case is stronger.

 

In future don't sell an iphone on eBay.  Buying and selling iphone is extremly high risk of loss with disputes.

I have messages that he sent me saying he paid to get it unlocked and that it passed activation by Apple but it wouldn't work on any other carriers.  Which it was only suppose to be used with Verizon (that how it was listed) Network locked!

Your mesages don't matter here.  If you think they are important you need to provide them to PayPal.  PayPal will make a decsion according to their internal review policies and decide who is telling the truth.

 

Can you actually PROVE the messages are from the buyer?  Messages and images can be created.

Is the case open on Paypal now?

Then upload the email which he said he has altered the iphone.

if closed in his favor,then appeal.

If he wins the case,he has to return the iphone on his dime. in the same condition sold.

He could also go to his CC issuer and file a chargeback.

Then you will be notified by Paypal and they will forward all the material you have,his cc issuer will decide,if you lose, a $20 chargeback fee is yours to pay.

But cc issuer is pretty good now in evaluating cases,make it easy for them to understand your case,attach exhibits.

if the seller wins a case on Ebay but lost it on Paypal,Ebay may have to pick up the tab,but I am not sure ,so you may want to call Ebay as well.

It sounds like the case has been escalated to get PAYPAL INVOLVED and Paypal has decided that he should return the item?

if so,has the buyer uploaded tracking,is it on its way to you?

is not ,appeal.

Paypal is swarmed with disputes and most disputes are handled by robot the first pass,then a person will get involved .

next time,sell iphone on Craigslist,and take cash
