Payment then Refund..

So, if a seller refunds me money for an item that I paid for and received, yet didn't ask for a refund on, is it at that point, my money?

They're claiming it's theft if I don't return the money. I don't believe it is. Comments?

(P.S. I'm going to pay the money back, I just want to be sure that the money received is technically "mine".)

It may, or it may not. I would recommend checking with an attorney in your region to be certain.  However, it seems like you're going to do the right thing and return the funds, so, problem solved
