Out of state vendor charging me sales tax erroneously

Hello, I am in the continental US and purchased something online from a small vendor that is in New York City. He has setup Paypal to charge sales tax on all orders, even orders that are out of state (which I am). I contacted Paypal and they say that if he's setup his account incorrectly there is nothing they can do about it and that I have to deal with him. I don't know if he's only used to local sales where he rightfully can charge sales tax, but he just says that that's the way it is. Is there any way to get through to him that he can't charge sales tax out of state?

You can ask for a refund.
You can ask for he local sales tax collection certificat for the state.
You could report him to his state department for sales tax collection.
It's not a PayPal issue.
